Tax Concessions & Offsets for People with Disability in the NT
Australians with a disability, their carers, and family providers are entitled to vital tax offsets, GST exemptions on motor vehicles, and tax-free government payments under Australian Taxation Office (ATO) legislation. Northern Accountants ensures Darwin and Palmerston families claim every legitimate regional and medical entitlement.
Is NDIS Funding Taxable in Australia?
National Disability Insurance Scheme (NDIS) funding received by participants is completely exempt from income tax and Goods and Services Tax (GST).
Under Australian tax rulings, NDIS amounts provided to participants, plan nominees, or registered plan managers constitute non-assessable, non-exempt (NANE) income. You do not report NDIS payments on your annual individual tax return.
Because NDIS payments are not assessable income, participants cannot claim personal tax deductions for support services, therapy, assistive technology, or consumable items purchased using NDIS funds. However, independent support workers and sole traders providing NDIS services must declare their client fees as assessable business income.
Tax Treatment of the Disability Support Pension & Carer Payments
The Disability Support Pension (DSP) and Carer Allowance are generally tax-free, provided specific age and payment conditions are satisfied under the Social Security Act.
- Disability Support Pension (DSP): Exempt from income tax if the recipient is under the statutory Age Pension age. If you have reached Age Pension age, the DSP is taxable, but the Seniors and Pensioners Tax Offset (SAPTO) frequently eliminates income tax liability.
- Carer Allowance: 100% tax-free income supplement regardless of your age or your care recipient's age. It does not need to be declared on your tax return.
- Carer Payment: Tax-exempt if both you and the person receiving care are under the Age Pension age. If either party has reached Age Pension age, the payment becomes assessable income.
GST-Free Cars and Vehicle Modification Concessions
Under Subdivision 38-B of the GST Act, eligible individuals with a disability who are gainfully employed can purchase a motor vehicle or vehicle modifications completely GST-free.
Section 38-55 of the A New Tax System (Goods and Services Tax) Act 1999 provides that you can purchase a new or used motor vehicle without paying GST if:
- You have a disability affecting your mobility that prevents you from using public transport; and
- You intend to use the vehicle for personal transport to or from gainful employment (including part-time work or self-employment) for at least two years or 40,000 kilometres.
Eligible car modification services and dedicated disability driving controls can also be acquired GST-free, saving Territory families thousands of dollars when fitting accessible vehicles.
Medicare Levy Exemption & Reduction Categories
People with certain medical conditions, permanent disabilities, and low-income pensioners qualify for full or partial exemptions from the standard 2% Medicare levy.
The ATO provides three distinct exemption categories on the individual tax return:
- Category 1 (Medical Reasons): Covers blind pensioners, sickness allowance recipients, and individuals with a valid Medicare Entitlement Statement certifying non-entitlement to Medicare benefits.
- Category 2 (Foreign Residents): Applies to individuals residing outside Australia for tax purposes.
- Category 3 (Dependants): Applies where you have dependants who are exempt persons or where your family income falls below statutory threshold phases.
Invalid Carer Tax Offsets and Zone A Remote Loading
Territory residents caring for an invalid spouse, parent, or child can access the Invalid and Invalid Carer Tax Offset (IICTO) alongside enhanced Northern Territory Zone A remote loadings.
If you maintain an invalid dependant receiving a disability support pension or carer payment, you may be entitled to claim the federal Invalid Carer Tax Offset. In Darwin and Palmerston, maintaining an invalid relative also directly increases your Zone A tax offset:
- Base Zone A Offset: Standard $338 tax offset for maintaining residence in Darwin for more than 183 days.
- 50% Dependent Loading: An additional 50% of the relevant dependant rebate is added to your Zone A credit, boosting your tax refund.
- Prior-Year Rollovers: If you moved to Darwin during the tax year, our tax agents apply multi-year rollover rules to calculate your total allowable offset.
Superannuation Access Under Permanent Incapacity (TPD)
If a permanent physical or mental disability prevents you from ever working again in a role for which you are qualified, you can access your accumulated superannuation early under Total and Permanent Disability (TPD) provisions.
Superannuation released under permanent incapacity contains a formula-based tax-free invalidity component. The tax-free portion is calculated by referencing your prospective service period up to age 65, significantly minimising or completely removing lump-sum withdrawal taxes.
